During a domestic disturbance call on September 3, 2022, Monroe County Sheriff Deputies found themselves in an investigation themselves with an officer involved shooting.
The use of deadly force which was non-fatal was investigated by detectives of the Highway Patrol. This is standard practice in a situation where there has been a discharge of a firearm by a law enforcement officer.
Monroe County Prosecuting Attorney Nicole Volkert has reviewed the Highway Patrol investigation report as to whether the use of deadly force was justified.
Volkert states, “After consideration and review of the video evidence, interviews and other records of the Patrol. I have determined the use of deadly force by the law enforcement officer on September 3, 2022, was justified.”
The defendant in the underlying case, Austin Tyler Leigh, 41, of Paris, formally of Iowa and Nebraska, has plead guilty to Domestic Assault in the Fourth Degree, and Resisting Arrest in a manner that caused a risk to life the deputy involved by driving at him.
The defendant faces three counts of Class E felony of domestic assault in the fourth degree and a Class E felony resisting a lawful stop.
The Prosecutor has confirmed that Leigh has plead guilty to three E felonies which each carry up to 4 years in prison. Sentencing is set for April 13 with Judge Rachel Bringer Shepard. Currently, Leigh remains in custody.
